I have only skimmed over the information about Lou Pearlman making money from the German musical group he founded. From what I read, they fired him. Why would they still give Pearlman money if they fired him? Being fired means no paycheck. Pearlman does not "own" these people, anymore than he owns his previous bands. He no longer gets a dime from any of those rich musicians.

And by any chance in the universe if Pearlman was getting any money, it would not come straight to him, he would find a way to funnel it to someone else, somewhere else.

As much as I dislike Kapilla for suing me, I do not think he is stupid or easily tricked or mislead. If there is any money to be found, I believe he wants very much to find it. I also believe he would like to see the victims reimbursed as well & also get his own paycheck for all the work & time his attorneys have done on this case. After all, that is his job & having a successful outcome to this case would only make himself & his firm look good.

I just found your email on the scammedbypearlman.com website. I have a feeling you might want to know the following information. There is plenty of money being made by the band that Lou started and STILL owns part of. But Kapilla is not going after them. He started it seems and then stopped because they were in Europe and ignored the American courts. Well they are not in Europe now! And he still is ignoring the money they generate. There was just a press release last week about how they have a new investor putting millions into the hands of the management to just bring them to the US! They left Lou's name out of the press release but still credited him as a "music industry executive". And they brag that they had the idea to work with the band because Lou said he could make hundreds of millions off of them at his sentencing. Yet, Mr. Kapilla is still not going after them. So I think its just because not enough people are demanding answers on why he is ignoring them. After all... he hired a consultant to determine how to run this band and the court paid for that fee!

I hope you will take the time to read the email I sent to Kapilla. I even have the points footnoted with proof because some people seem to think the band is free of Lou. Even the band's attorney's know better. But here is the emai....

I am writing with a glimmer of hope that I can appeal to you as an officer of the court. Justice is not being served and its seems as if the only reason could just be neglect. They say, “out of sight, out of mind” and it appears that has become the new precedent for the Lou Pearlman court case.

I found your name on an earlier filed court document for Lou Pearlman, and I am hoping that some of the latest news regarding this case will spark your interest. These developments seem to be largely ignored by the key players in this case. Is it because the elements are “out of sight” or is it just prudent?

Like many people I am in awe of the aggressiveness of the trustee, Soneet Kapilla, to pursue the clawback claims for Mr. Pearlman. But I am shocked and mystified over the lack of similar aggression to pursue money that belongs to Mr. Pearlman. After all, it was Mr. Pearlman himself who testified of the benefits of this money pot he was holding.

Let me outline some points that I have discovered since reading a recent press release. Perhaps these facts will entice you to review your previous actions in the Pearlman case and speak to the court or maybe it will prompt a desire to provide an amicus curiae brief to make sure that justice is done. Either way there are many people out there who are hoping that the courts will hear their voices for justice.

I hope that you will read each point listed below to remind yourself of this particular asset of Lou Pearlman and all of its elements before being forgotten. At the end of the different points I will point out what major development just occurred that prompted this email!

So please allow me to introduce one of Lou Pearlman's assets....

WHO IS US5?

US5 is the boyband that was started by LOU PEARLMAN when those in the music industry thought his days for creating boy band magic was over. This was the time immediately after N'Sync and Backstreet Boys escaped his clutches.

Lou Pearlman is still 1/6th owner of US5. The US Bankruptcy Court, Middle District of Florida, Orlando Division has assigned ALL assets of Pearlman to a court appointed trustee, Soneet R. Kapila. Mr. Kapila immediately seized anything US5 related even as small as a internet URL address. That can be seen when you try to type US5.com.1

The members of the band, US5, know that they are still owned by Lou Pearlman. One member of the band recently mentioned that the “new” contracts referenced their ongoing connection to Mr. Pearlman. US5 could have used the courts to remove their affiliation with Lou Pearlman like artists Aaron Carter and Sean van der Wilt. These two artists went to the bankruptcy court and asked to be released from their management and recording contracts.2

Lou Pearlman knew the earning potential of US5, and stated during his sentencing that he would do “whatever I can” in providing expertise of the music industry to make money for the people he scammed. He was hoping to be allowed to take over the management of his band to pay back the hundreds of millions of scammed money.3

The judge presiding over Lou Pearlman's criminal case did allow a glimmer of hope to the convict. For every million dollars he could earn, the judge would reduce the sentence of 25 years by one month. The only source of income for Lou Pearlman is his involvement with the boy band, US5 and the liquidation of his assets.4

Vanity Fair printed an article (and used photos of the band US5) that described the allegations of Lou Pearlman and inappropriate sexual advances on the members of his boy bands that were hoping to “make it big”. Pearlman's “passion for boys” led to much speculation that Lou would lavish gifts on those he “adored”5

The court appointed trustee in the Lou Pearlman case sent investigators to Germany to research missing millions of dollars and other allegations of money Lou spent in the country. One allegation investigated and documented in the affidavit was the condominium Lou Pearlman bought for Jay Kahn, a member of the boy band US5.6

US5 has had numerous members quit the band because of allegations of mismanagement, their attachement to Lou Pearlman, and missing money. Chris Watrin recently quit the band after going to the press saying all of the issues with US5 was destroying him. One of his statements before his mental breakdown, “The exit is the only way. It saves my life”.7

Another member, Vince Tomas, quit the band recently and also spoke to the press about his departure. He described the missing millions of dollars, physical and mental abuse, sexual scandals, and complete mismanagement.8

US5 is not innocent when it comes to sexual scandals like those that plagued Lou Pearlman. A few years ago, US5 band member Jay Kahn was caught with fellow band member Richie Stringini in a closed door bathroom stall of a Berlin gay club. Another club patron snapped a picture of the two of them using his cell phone camera. The picture showed Jay Kahn possibly performing oral sex on Richie Stringini. In the picture you can clearly see Richie's expression of pleasure as a dark haired individual is between his legs. The band management was quick to point out that while the two individuals were in a gay club, they were not gay or performing sex. Just a situation where one band member was helping another in the bathroom who was sick from drinking too much “cola” and they didnt know it was a gay club.9 10 11

A member currently in the band had quit the same time as Vince Tomas but then rejoined after being forced to rejoin by member Jay Kahn. However, he posted a picture on his FaceBook profile of standing on the edge of a high rise hotel in Berlin and posting a cryptic poem on his website about lies, deceit, and hinting at suicide and drug use.12

US5 Management in North America

A press release announcing the involvement of US5 in the Michael Jackson tribute states that Playground is the new management company of Lou Pearlman's band in North America. Wouldn't the trustee for Lou Pearlman's bankruptcy have to petition the court for the band to switch management? Isn't the act of the band making their own arrangements be illegal according to orders of the US District Court and US Bankruptcy Court? 13 14

The President of Playground appears to have changed his company name after being sued by KISS and Gene Simmons for non payment. Dennis MacDonald was sued while being President of Big Mountain Concerts. Now his company claims to be a concert company and artist management company. Prior to Big Mountain Concerts it would appear the company went by the name Shout Resort Concerts. 15

Press releases were filed last week discussing how this new North American management for US5 is part of a joint venture agreement with their other management, Triple-M. Triple-M who is Lou Pearlman entrusted the boys with upon their creation. The joint venture seems to be all encompassing into every area the band could generate income. 16

With the joint venture agreement between Triple-M and Playground in place, Playground has now developed a joint venture agreement with Mike Marridino of Primary Petroleum. 17

Mike Marridino created the company Worldwide Promotional Management and has recently opened the company to trading on the Canadian Exchange in order to raise capital. The Canadian Exchange listed the company as of August 14th with an initial public offering. 18

The newly created company, Worldwide Promotional Management, announced on September 8th that they will be acquiring Playground. The agreement details how almost two million dollars will exchange hands just for the purpose of transferring the contractual obligations of the band US5. 19

Another partner within the myriad of individuals benefiting from US5's potential is Skanderbeg Capital. They recently began airing a video on YouTube that brags about the accomplishments of US5 since their creation by Lou Pearlman. 20

The European Michael Jackson Tribute concert invited US5 to participate in the show. Was money offered? 21

Unanswered Questions

This small collection of facts begs to have the court pay attention to the endeavor as a whole. Perhaps the court will look into the matter to determine how much money Lou Pearlman has generated through his band US5. Or does the trustee not consider the money generated from a working band, created and contracted with Lou Pearlman as lucrative as the clawback claims he is seeking against victims of Pearlman's fraud. Hopefully the latest video and press releases will open the eyes of the court and entice them to pursue justice.

How can management and recording contracts so freely change hands or add new parties without the consent or acknowledgement of the courts?

How much money did Disney pay when the many managers of Pearlman's band when they used the band US5 for the High School Musical soundtrack?

How much money has been generated by all of the album sales of US5. The video clearly shows that many albums ranked as gold or platinum. Since these rankings indicate minimum numbers of albums sold it is easy to extrapolate that quite a bit of earnings have gone to someone. Has Lou received 1/6th of his earnings?

Is the court not concerned by the many contracts, letters of interest, and now a public stock offering surrounding US5? When the bankruptcy court took control of Lou Pearlman's assets they seized everything of US5 they could control. The seizure even included internet URL addresses of the boy's personal names to demonstrate how far reaching. How can the court ignore all of the recent activity of the same entity that was the act of such far reaching seizures?

Would the court not have the right to seize the roughly two million dollars exchanging hands as a result of the many contracts and letters of intent dealing with who controls the band that Lou Pearlman created?
